Terms and Conditions

These Terms and Conditions set out the rules for the TGC Homes Black Friday Launch $30,000 Settlement Cashback Promotion (the “Promotion”). By entering into an eligible property purchase during the Promotion Period, purchasers agree to these Terms.

This Promotion is offered by TGC Homes (“TGC Homes”, “the Promoter”).

Promotion Overview

TGC Homes is offering a $30,000 Settlement Cashback to the first three (3) purchasers who enter into a Qualifying Contract during the Promotion Period and who fully settle the purchase in accordance with their Sale and Purchase Agreement.

This Promotion applies only to selected TGC Homes developments listed below:

  • 31 Bayfield Road, Andersons Bay, Dunedin
  • 58 Mailer Street, Mornington, Dunedin
  • 94 Musselburgh Rise, Musselburgh, Dunedin

Promotion Period

This Promotion runs from:

24 November 2025 until 19 December 2025, or until the first three (3) Qualifying Contracts have been accepted by TGC Homes (whichever occurs first).

TGC Homes may amend the Promotion Period at its discretion, but not after a Qualifying Contract has been entered into.

Eligibility Criteria

To be eligible for the $30,000 Settlement Cashback, purchasers must meet all of the following:

  • Direct Purchase: The property must be purchased directly from TGC Homes. Purchases through third-party real estate agents, introducers, or indirect channels are not eligible unless explicitly approved in writing by TGC Homes.
  • Purchase Price: Properties purchased at any discounted price, rebate, or using other promotional pricing are not eligible, unless this Promotion’s terms explicitly permit the combination. The Two-Year Rental Guarantee does not affect eligibility as long as the purchase price itself is not discounted.
  • Unconditional Contract Within Period: The Agreement for Sale and Purchase (“S&P Agreement”) must be:
    • Signed by all parties within the Promotion Period;
    • Accepted by TGC Homes within the Promotion Period; and
    • Become unconditional within the timeframe required in the S&P Agreement.
  • Settlement: Purchasers will only be eligible for the promotion if they settle in full without deduction, set off or other withholding on the Settlement Date. Should the Purchaser fail to strictly comply with all conditions and terms set out in the S&P Agreement, then they will not be eligible for this promotion.
  • Community Housing Organisations: The Government, NGOs and community housing organisations are not eligible for this promotion.
  • Age and residency: Entrants (buyers) must be at least 18 years of age. The promotion is open to New Zealand residents only. 

By entering (via an eligible purchase), participants confirm that they meet all the above criteria and agree to these Terms and Conditions. The Promoter reserves the right to verify eligibility and to disqualify any entrant who does not comply with the requirements.

Qualifying Contract

A Qualifying Contract is a Sale and Purchase Agreement (S&P) that:

  • Is signed by all parties and accepted by TGC Homes during the Promotion Period;
  • Relates to a property identified by TGC Homes as part of the Black Friday Launch Promotion;
  • Becomes unconditional within the timeframe in the Agreement; and
  • Settles in accordance with the Agreement.

Contracts that lapse, are cancelled, or do not settle do not qualify.

Allocation of the “First Three” Cashback Recipients

The cashback will be allocated to the first three Qualifying Contracts based on:

  • The date and time a fully executed Agreement is received and accepted by TGC Homes; and
  • The Agreement subsequently became unconditional.

If a contract fails to go unconditional, the next eligible contract in time order will receive the cashback.

TGC Homes’ determination is final.

$30,000 Settlement Cashback


Amount and Payment

  • The cashback amount is NZD $30,000.
  • Paid to the purchasing entity through a credit note on the settlement statement at settlement.
  • Cannot be redeemed early, offset against the purchase price, or transferred.

Conditions

The cashback is payable only if:

  • The purchaser strictly complies with all S&P Agreement terms;
  • Settlement is completed in full and on time;
  • There are no deductions, set-offs, retentions, delays, or purchaser breaches.

If the purchaser cancels, withdraws, or otherwise fails to settle, the cashback is forfeited.

Combination With Other Offers

The $30,000 Settlement Cashback cannot be combined with any other offer, promotion, or incentive unless TGC Homes provides written approval.

Musselburgh, Mailer and Bayfield developments also come with the Two-Year Rental Guarantee, which will not be impacted by the $30,000 Settlement Cashback promotion.

Publicity and Announcement

TGC Homes may publicly acknowledge purchasers who receive the $30,000 Settlement Cashback only with the purchaser’s prior written consent. Any acknowledgement may include the purchaser’s name and city, and may appear on TGC Homes’ marketing channels such as its website, social media, or email updates. Publicity will relate solely to this promotion and TGC Homes’ associated marketing activity.

Purchasers may also be invited to provide a brief comment or image about their experience; participation in any publicity is entirely voluntary.

Any personal information collected for this promotion will be used solely for administering the promotion and for marketing communication only where the purchaser has opted in. Personal information is collected and managed in accordance with the Privacy Act 2020. Please read our Privacy Policy on how we handle your personal information.

Additional Terms & Legal Compliance

  • Promoter: The promoter of this Promotion is TGC Property Limited (TGC Homes). The office address is 74 David Street, Caversham, Dunedin. Any questions regarding this Promotion can be directed to the Promoter via email at george@tgc.nz.
  • Promotional intent: This Promotion is a sales incentive exclusively for purchasers of eligible TGC Homes properties. The $30,000 Settlement Cashback is provided as an additional promotional benefit to qualifying purchasers who enter into a property transaction during the Promotion Period. There is no separate fee or cost to participate in the Promotion beyond the property purchase itself, which is undertaken for its own intrinsic value as a real estate transaction. This Promotion is not a lottery, gambling activity, or game of chance. Its primary purpose is to incentivise property sales and it is conducted in compliance with the Fair Trading Act 1986, the Consumer Guarantees Act 1993, the Contract and Commercial Law Act 2017, and all other applicable New Zealand laws and regulations.
  • Decisions are final: The Promoter’s decisions regarding all aspects of this Promotion are final. This includes decisions about eligibility, acceptance of qualifying contracts, the order in which contracts are recorded for cashback allocation, disqualification, and interpretation of these Terms and Conditions. No correspondence will be entered into challenging any decision. The Promoter will act fairly and reasonably and will administer this Promotion strictly in accordance with these written terms.
  • Variations and cancellation: The Promoter reserves the right to modify, suspend, or cancel the Promotion if, for any reason, continuation becomes untenable or unlawful. Situations that may require such action include natural disasters, supply chain disruptions, significant operational issues, or changes in law. Any updates to the key terms will be communicated as soon as practicable. No variation will disadvantage purchasers who have already entered into a Qualifying Contract, and any variation applies only prior to acceptance of new Qualifying Contracts. The Promoter may also update these Terms and Conditions where necessary to comply with applicable law or to clarify rules.
  • Liability: To the fullest extent permitted by law, the Promoter and its directors, employees, and agents are not liable for any loss, damage, claim, expense, or injury arising out of or in connection with this Promotion, the cashback, or any related communication or activity. Once settlement has occurred and the cashback has been paid to the purchaser’s solicitor’s trust account, the Promoter has no further liability in relation to the cashback. Nothing in these Terms limits any rights that purchasers may have under the Consumer Guarantees Act 1993.
  • Acceptance of terms: By entering into a Qualifying Contract within the Promotion Period, purchasers agree to be bound by these Terms and Conditions. If a purchaser breaches these Terms, including by seeking undisclosed discounts or failing to settle in full, the Promoter reserves the right to withdraw the cashback and deem the purchaser ineligible.
  • Governing law: This Promotion and any related disputes are governed by the laws of New Zealand. Purchasers agree to submit to the exclusive jurisdiction of the New Zealand courts for the resolution of any dispute arising in connection with the Promotion.
  • Advertising disclaimer: This Promotion may be advertised across multiple channels, including digital advertising platforms, Meta platforms, social media, email, print, and external marketing environments. These advertising channels are not associated with, sponsoring, or endorsing this Promotion in any way. Participation in this Promotion removes any responsibility from Meta, Facebook, Instagram, or any other advertising platform. All advertising material summarises the Promotion only. In the event of inconsistency, these Terms and Conditions prevail over all advertising and promotional messaging.
